Ninth Circuit Decision Made in Line of Sight Case
The Ninth Circuit issued a decision today in Miller v. California Speedway, for which the DRLC and Board member, Carolyn Young, wrote an amicus brief on behalf of San Diego Polio Survivors. This case addressed whether stadiums are required to provide lines of sight over standing spectators for people in accessible seating. The plaintiff, Miller, uses an electric wheelchair. Although he had an accessible seat at the speedway, Mr. Miller’s line of sight was blocked when other spectators would stand up in front of him during the NASCAR races. The Honorable Judge Bybee, writing for the panel, held that stadiums have to provide line of sight over standing spectators for accessible seating. Click here to read opinion.
